Vacation Rentals

Hotels and lodging establishments may open for all guests, including tourists and leisure guests, provided they comply with the State COVID-19 Industry Guidance: Hotels, Lodging and Short-Term Rentals and post a Safe Reopening Plan on their premises. The COVID-19 General Checklist from the California Department of Public Health outlines steps operators of short-term rentals must follow for compliance with the county’s public health order.

In response to the COVID-19 emergency and the San Diego County Order of the Health Officer and Emergency Regulations, the Community Development Department has limited ability to investigate complaints. At this time, our priority is to protect public health and safety, focusing our resources on complaints of violations related to City of Carlsbad Municipal Code that are significant threats to public safety.

The Community Development Department does not interpret or enforce the San Diego County Order of the Health Officer and Emergency Regulations. The order requests that the Sheriff’s Office and all chiefs of police in San Diego County ensure enforcement of this order. Complaints related to the State Executive Order or San Diego County Order of the Health Officer and Emergency Regulations should be submitted to the San Diego County Sheriff or respective City Police Department.  

The City of Carlsbad has entered into an agreement with Vrbo/Homeaway to collect and remit TOT and CTBID assessments on short term vacation rentals booked on their platforms.  This is similar to the agreement we  have with Airbnb.  The agreement goes into effect February 1, 2020.  Any rentals booked through the month of January 2020, the taxes will need to be remitted to the City by the vacation rental owner. For rentals booked on Vrbo/Homeaway after February 1, 2020, Vrbo/Homeaway will be collecting and remitting the taxes to the City on the vacation rental owners behalf.

New rules for short-term vacation rentals went into effect Feb. 23, 2016, banning them except in the "coastal zone" and the La Costa Condominium Owners Association, known as the “La Costa Chateaus” at 2003 and 2005 Costa Del Mar.
